BluePunk Tattoo Terms and Conditions

Please read these Terms and Conditions carefully. All contracts that the Tattoo Artist may enter into for the provision of the Tattoo Artist’s services shall be governed by these Terms and Conditions.

 

1. Interpretation and Definitions

 

1.1 Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

1.2 Definitions

For the purposes of these Terms and Conditions:

  • Appointment means the date and time of confirmation of the services to be provided between the Tattoo Artist and Client, when the Deposit and Tattooing Services appointment have been confirmed in writing by the Tattoo Artist.

  • Business Day means any weekday, Monday to Friday inclusive, other than a bank or public holiday in Finland.

  • Business Hours means the hours of 10:00 to 18:00 on a Business Day.

  • Charges means the following amounts:
                (i) the amounts specified in Section 4
                (ii) such amounts which may be agreed in writing by the parties; and
                (iii) amounts calculated by multiplying the Tattoo Artist’s standard time-based charging rates (as notified by the Tattoo Artist to the                  Client before the date of a Contract) by the time spent by the Tattoo Artist performing the Services.

  • Client means the individual accessing or using the Service, or the company.

  • Contract means a particular contract made under these Terms and Conditions between the Tattoo Artist and the Client.

  • Deposit means the charge for Design Services and reservation of a Tattooing Service appointment date and time.

  • Design Services means the research, design, drawing, editing and correspondence which occurs prior to the Tattooing Services.

  • Force Majeure Event means an event, or a series of related events, that is outside the reasonable control of the party affected (including power failures, industrial disputes affecting any third party, changes to the law, disasters, explosions, fires, floods, riots, terrorist attacks etc.

  • Tattoo Artist means the individual Tattoo Artist who will be responsible for the design work and provision of the Tattooing Service.

  • Tattooing Services means the tattooing services specified in Section 3.   


 

2. Contract

2.1 A Contract will come into force upon the Appointment date and time.

2.2 A Contract will continue until:

  • all the Tattooing Services have been completed; and

  • all the Charges have been paid in cleared funds

upon which it will terminate automatically.

 

3. Services
 

3.1 The Tattoo Artist will provide the Design Service and Tattooing Service to the Client in accordance with these Terms and Conditions.

3.2 The Tattoo Artist will provide the Design Service and Tattooing Service in accordance with the standards of skill and care reasonably expected from a Tattoo Artist in the Tattoo Industry.

3.3 If the Client believes that any element of the Tattoo Service does not meet the standard specified in Clause 3.2, then the Client must promptly notify the Tattoo Artist and allow them to inspect the results of those Services and, if the Service does not meet that standard, re-perform that Service, as within their ability.

3.4 The Tattoo Artist shall devote their time and expertise to the performance of the Design Services and Tattooing Services as may be necessary for their satisfactory and timely completion.

3.5 The Tattoo Artist shall comply with all reasonable requests and directions of the Client in relation to the Services.

3.6 The Client does not legally own any design or artwork created by the Tattoo Artist. The copyright belongs to the Tattoo Artist and any attempt to use the designs without permission will result in legal action being taken to protect said copyright.

3.7 The Design Services include research, design, drawing, editing and correspondence by the Tattoo Artist. This work is covered by the Deposit paid by the Client. Clients may be asked to pay additional charges for the following reasons:

  • More than three small design changes

  • Complete change of original idea, including subject, style, shape, size and area of the body to be tattooed

3.8 A Tattoo Artist can legally decline to provide Design Services and Tattoo Services for reasons related to their professional judgment and artistic specialisation, as long as the refusal is not a pretext for discrimination. Examples of legal reasons to decline to provide Services include:

  • The requested design falls outside the Tattoo Artist’s specific style or technical skill set

  • The requested design is considered offensive or violates the Tattoo Artist’s personal or professional ethics

  • The placement of a requested tattoo is considered to be of poor judgement by the Client

  • The behaviour of the Client is considered inapropriate

3.9 A Tattoo Artist will not refuse service for any attribute which falls under the protection of Finland’s Anti-Discrimination Act. This includes sex, age, origin, language, religion, conviction, opinion, health and disability.

4. Tattoo Appointments

 

4.1 The Tattoo Artist will provide the Tattooing Service during Appointments commencing on the date(s) and at the time(s) agreed between the parties.

4.2 If a Client wishes to reschedule an Appointment, then they must give a written request for rescheduling, at least 48 hours before the Tattooing Service Appointment is due to commence. In these circumstances, the Tattoo Artist will use all reasonable endeavours to agree an alternative Tattooing Services Appointment. If notice is given less than 48 hours before the Appointment time, the Client will be liable to pay another Deposit before being able to book a new Appointment time.

4.3 If a Client does not attend or is over 30 minutes late to the Appointment, the session will be cancelled and the Client will have to pay a new Deposit before being allowed to book a new Appointment time.

4.3 The Client may cancel a Tattooing Services Appointment by giving the Tattoo Artist at least seven Business Days’ notice of cancellation. If the Client cancels a Tattooing Service Appointment in accordance with this section 4.3, then the Client shall be released from any liability to pay Charges in respect of the relevant Services. The Client will not be entitled to a refund of the Deposit/s already paid.

4.4 The Tattoo Artist will not be liable to the Client in respect of any losses arising out of a Force Majeure Event.

4.5 If the Tattoo Artist is unable to attend a Tattooing Services Appointment by reason of illness, the Tattoo Artist may cancel or reschedule the Appointment by written notice to the Client, in which case:

  • the Tattoo Artist will not be in breach of these Terms and Conditions or otherwise liable to the Client in respect of a failure to supply the relevant Services; and

  • the Client shall be released from any liability to pay Charges in respect of the relevant Services and shall be entitled to a refund of any Charges previously paid in respect of those Services.

4.6 The Client must provide any reference material and/or fonts at least five Business Days before the Effective Date. Failing to provide reference material on time or making changes in the 48 hours prior to the Tattooing Services Appointment may result in a further design fee of 50€.
4.7 If the Client requests changes during the Tattooing Service, they may be liable for additional Charges as determined by the Tattoo Artist.

4.8 The Client must agree to follow the Tattoo Artist’s instructions regarding preparation for their Appointment, as per the directions found at the ”Before Your Appointment” page on the BluePunk Tattoo website. If such instructions are not followed by the Client and the Tattooing Services are ended early at the request of either party, the Client is liable to pay the full Charges outlined by the Tattoo Artist on the Appointment Date.

4.9 If the Client wishes to disclose any health issues that may effect their Appointment, they should do so before the Appointment time commences. This will give the Tattoo Artist time toi make any reasonable adjustments, if possible. Example relevant issues include, but are not limited to:

  • Allergies

  • Medications which could effect the tattooinng process or healing process, for example, anticoagulants

  • Mobility issues

  • Skin conditions

4.10 It is the Tattoo Artist’s responsibility to make any adjustments to accommodate any health issues or disabilities as best as they can and within their means. No Client will be refused Tattooing Services based on a disability or health condition, as per section 3.9. Futher information can also be found at www.bluepunktattoo.com/accessibility.

4.11 The Tattoo Artist will not provide Tattooing Services to anyone under the age of 18, regardless of any documentation from legal guardians. All Clients must provide valid photo identification prior to the Tattoo Services taking place.

 

5. Aftercare

 

5.1 The Client must follow all instructions given by the Tattoo Artist regarding taking care of their new tattoo. The Tattoo Artist is not responsible, in any way, for any infection, injury or poor appearance if the Client does not adhere to any advice given.

5.2 It is the Tattoo Artist’s responsibility to provide aftercare advice verbally and in writing on the day of the Tattoo Services taking place. This information can also be found at www.bluepunktattoo.com/tattooinfo under the ”After Your Tattoo” section.

 

6. Charges

 

6.1 Deposits for Design Services must be paid by the Client on the date specified by the Tattoo Artist. The Deposit ensures a Tattooing Services Appointment date is secure and also pays for the Design Services.

6.2 Deposits will be between 50 – 150 euros and must be paid in the means specified by the Tattoo Artist.

6.3 The deposit is non-refundable in any situation other than those specified in section 4.5.

6.4 The Deposit amount is deducted from the total payment of the final Tattooing Services appointment.

6.5 The Client shall pay the Charges to the Tattoo Artist in accordance with these Terms and Conditions.

6.6 All amounts stated in or in relation to these Terms and Conditions are, unless the context requires otherwise, stated inclusive of any applicable value added taxes.

 

7. Payments

 

7.1 Payments must be completed by the Client, in full, by the end of the Tattooing Services appointment.

7.2 The Client must pay the Charges by cash, debit card, credit card, MobilePay or bank transfer using the payment details notified by the Tattoo Artist to the Client.

7.3 Delay of any payments or Charges by the Client will result in an interest Charge being added. The interest payment will comply with standards set by the Finnish Government.

 

8. Termination

 

8.1 The Tattoo Artist may terminate a Contract with a Client at any time if they experience any behaviour which they deem to be inappropriate from the Client, or anyone representing the Client. Such behaviour includes, but is not limited to:

  • Verbal, written, physical or sexual abuse

  • Excessive micromanagement of Design Services or Tattooing Services

  • Discriminatory language or behaviour, including, but not limited to; racism, homophobia, misogyny and xenophobia

  • Unwanted sexual remarks or physical contact

  • Repeated cancellation, absence or poor punctuality for Tattoo Service appointments

8.2 Either party may terminate a Contract immediately by giving written notice of termination to the other party if the other party commits a material breach of these Terms and Conditions.

 

9. Webstore

 

9.1 The Webstore cannot take returns for any reason other than the ones listed in Section 9.2.

9.2 If a Client has any of the following issues with any merchandise purchased by from the Webstore, they will be entitled to an exchange or refund in accordance with Section 9.5 and 9.6:

  • Merchandise arrived faulty or damaged

  • The size on the order does not correspond with the size of garment sent

9.3 Under no circumstances other than those listed in Section 4 and Section 5, will deposits, tattoo payments or gift vouchers be refunded.

9.4 BluePunk Tattoo will not accept any liability for items lost or damaged in transit.

9.5 If the Client has either of the issues specified in Section 9.2, they will have 30 calendar days to return an item, from the date it was received. The returns address is: BluePunk Tattoo, Pitänsillanranta 17, Helsinki 00530, Finland.

9.6 To be eligible for a refund or exchange, the merchandise purchased by the Client from the Webstore must be unused and in the same condition that it was received. The merchandise must be in the original packaging.

9.7 Any merchandise sent to the return address by the Client must have the receipt or proof of purchase included.

9.8 Once the merchandise has been received by BluePunk Tattoo, it will be inspected and the Client will be notified that the merchandise has been received and on the status of the refund.

9.9 If the Client’s return is approved by BluePunk Tattoo, a refund for the amount of the merchandise will be credited to the Client’s original form of payment. The Client will receive the credit within a certain amount of days, depending on the Client’s card issuer's policies.

9.10 If MobilePay has been used for the original purchase, the Client will be contacted by BluePunk Tattoo to arrange a refund.

9.11 The Client will be responsible for paying any shipping costs for returning any merchandise. Shipping costs are always non-refundable. If the Client receives a refund, the cost of return shipping will also be deducted from any refund given.

9.12 BluePunk Tattoo is not responsible for items damaged or lost in the post process and therefore strongly recommend the Client uses a type of postage which generates a tracking code.

9.13 Any merchandise purchased from the Webstore will be dispatched within 3 to 5 Business Days. Deliveries are made via Posti and delivery times vary depending on the shipping option the Client selects. All approximate delivery times can be found at www.posti.fi.

9.14 All physical merchandise is guaranteed under EU law for two years, The two-year period starts from the day the Client received the product.

 

10. Gift Cards

 

10.1 BluePunk Tattoo Gift Cards may be used only for purchases in Finland for Design Services or Tattooing Services. Gift Cards cannot be used for any merchandise or to purchase another gift card.

10.2 Gift Cards are not redeemable for cash, including any unused balance.

10.3 BluePunk Tattoo is not responsible for lost or stolen Gift Cards or for use without the Client’s permission.

10.4 Gift Cards are not for resale.

10.5 BluePunk Gift Cards have no expiration date; however, the location of BluePunk Tattoo’s permanent business address may change over time.
10.6 Gift Cards will not be refunded under any circumstances.

 

11. Company Information

 

11.1 BluePunk and Blue Punk Tattoo are registered Trademarks (Registration number 280924).

11.2 All website content, including images, shop products and copy, are copyrighted material and belong to BluePunk Tattoo. All apparel and merchandise designs are by BluePunk Tattoo and are copyright.
